New York Attorney General Letitia James is still holding President-elect Donald Trump’s feet to fire regarding the civil fraud case against him.

James, who has argued presidents are not immune from civil litigation, is awaiting the appeal court decision on the matter, per Fox News.

“The ordinary burdens of civil litigation do not impede the President’s official duties in a way that violates the U.S. Constitution,” Deputy Solicitor General Judith Vale wrote to Trump attorney D. John Sauer, per The Hill.

Trump’s attorneys have asserted that James drop the civil fraud case against Trump “for the greater good of the country,” Fox News reported.

James won a civil lawsuit against Trump, who was then ordered to pay $454 million.

A New York judge found Trump and his business altered his net worth for tax and insurance purposes, after also finding them liable for fraud.

Trump has appealed.

James’ office said on Tuesday that it is not going to drop the case against Trump since, as it alleged, presidents do not have immunity from civil litigation arising from unofficial conduct.

It said lawsuits “may proceed while the president is in office.” 

The office also said that the civil matter “does not in any way affect Trump’s ability to serve as president.”
