Pelosi Breaks With DOJ on Indictment of a Sitting President: ‘I Do Not Think That Is Conclusive’

Rep. Nancy Pelosi is about to take on the role of speaker of the house on Thursday, and with it, she will be taking on President Donald Trump.

In an interview aired this morning on the “Today Show,” host Savanah Guthrie asked the California congresswoman if she agrees with the Justice Department’s guidance on not indicting a sitting president.

“I do not think that is conclusive,” Pelosi answered. “No, I do not.”

Pelosi tried to change the conversation, saying, “Let’s just see what Mueller does. Let’s spend our time getting results to the American people.”

But when pressed about the issue, Pelosi stood firm in her belief that the Justice Department could be challenged on their advice. “It’s not the law, everything indicates that the president can be indicted after he’s no longer president of the United States,” she said adding: “I think that is an open discussion. I think that is an open discussion in terms of the law.”

An indictment is one thing. But for many Democrats, especially a lot of today’s newcomers, impeachment is on the mind.

However, Pelosi acknowledged that impeachment would be “sad and divisive” for the country, but wouldn’t rule it out if it was necessary following the results of Special Counsel Robert Mueller’s investigation into the Trump campaign and possible ties to Russia.

“We would have to wait and see what happens with the Mueller report,” she said. “We shouldn’t be impeaching for a political reason and we shouldn’t avoid impeachment for a political reason, we just have to see how it comes.”

The 116th Congress gets sworn in Thursday, ending the eight-year-long control by Republicans. Pelosi will almost definitely be voted in by her colleagues, old and new, as speaker of the house for the second time in her tenure as a congresswoman.
