President Donald Trump said Tuesday he plans on attending the oral arguments at the Supreme Court regarding birthright citizenship.

The justices will hear arguments in the case, Trump v. Barbara, which will weigh in on the constitutionality of his attempt to end birthright citizenship for children born to illegal aliens. This would mark the first time in U.S. history that a sitting president attended oral arguments.

“I’m going,” Trump told Fox News’ Peter Doocy. “I think so. I believe so. Because I have listened to this argument for so long, and this is not about Chinese billionaires or billionaires from other countries who all of a sudden have 75 children or 59 children in one case or 10 children becoming American citizens. This was about slaves, and if you take a look, slaves, we’re talking about slaves from the Civil War, and if you take a look at when it was filed, all of this legislation, all of this, everything, having to do with birthright citizenship, it was at the end of the Civil War.”

Trump signed an executive order on Jan. 20, 2025, which ended guaranteed citizenship for children of illegal aliens or migrants on temporary visas. The case immediately received pushback from left-wing groups, who filed lawsuits on behalf of the children of illegal aliens.

The U.S. is one of 37 countries that guarantee birthright citizenship and is among only 30 countries to have no restrictions. After the Civil War, the 14th Amendment extended birthright citizenship to “All persons born or naturalized in the United States,” which included freed slaves and their children.

Trump argued that illegal aliens “lack ties of allegiance and do not obtain the ‘priceless and profound gift’ of citizenship for their children.” Opponents suing the administration argued his executive order is a “radical rewriting” of the Citizenship Clause of the 14th Amendment.

Between 225,000 and 250,000 children were born to illegal migrant parents in 2023, along with 70,000 born to temporary visitors, according to estimates from the Center for Immigration Studies (CIS).
