A California jury deadlocked on Thursday over a woman charged with crimes for posting a video criticizing an abortion clinic.
Most jurors believed Anastasia Rogers did not break the law when she posted a December Instagram video about how Planned Parenthood seeks to “unalive” babies in San Francisco, according to court records and media reports. The court declared a mistrial for Rogers, an activist with Survivors of the Abortion Holocaust who was arrested over the post while sidewalk counseling.

Anastasia Rogers was unable to reach a unanimous verdict, resulting in a mistrial.San Francisco District Attorney Brooke Jenkins’ office did not respond to the Daily Caller News Foundation’s request for comment. Jenkins’ office brought the case under California’s Freedom of Access to Clinic Entrances (FACE) Act, accusing Rogers of creating the video with intent to intimidate Planned Parenthood staff. She faces up to two years in prison if convicted on the two misdemeanor counts, according to California Family Council.
“Thank you so much for all of your support and your prayers, and I’ll definitely keep you guys updated if there is more coming,” Rogers said in a Thursday Facebook video posted by Pro-Life San Francisco. She warned, however, that “the case technically isn’t over.”
The 13-second video that put Rogers on trial shows her outside a San Francisco Planned Parenthood facility, contrasting her with a female clinic escort using the caption, “unalive them,” referring to unborn children. The video mimics a popular TikTok trend with music containing the lyrics, “Hey, is this illegal? Hey, it feels illegal.”
California’s FACE Act echoes the federal FACE Act that former President Joe Biden’s Department of Justice used to jail and prosecute peaceful pro-life protesters under the pretense of protecting access to abortion facilities. President Donald Trump pardoned nearly two dozen federal FACE Act defendants in January 2025.
Rogers’ jury leaned toward “not guilty” verdicts by nine to three and ten to two on her first and second counts, respectively, National Review reported. “Short of a unanimous not guilty verdict, this is good news to hear from a largely abortion-supporting San Francisco jury,” Pro-Life San Francisco said Thursday.
