Rep. Alexandria Ocasio-Cortez (D-N.Y.) is claiming Supreme Court Justice Samuel Alito has “identified himself” with those who stormed the U.S. Capitol on Jan. 6. in the wake of several stories about flags.

Alito has faced criticism after The New York Times published a report about an incident in 2021 when his wife, Martha-Anna Alito, flew the American flag upside-down at their Virginia home. And on Wednesday, the paper reported Alito flew a “Pine Tree Flag” — a flag that dates back to the American Revolution — outside his vacation home in New Jersey.

And during an appearance on MSNBC, Ocasio-Cortez seized on the linkage between the flag incidents to Jan. 6 rioters that many in the media have been making to attack the justice and suggest he should be investigated.

“Samuel Alito has identified himself with the same people who raided the Capitol on Jan. 6, and is now going to be presiding over the court cases that have deep implications over the participants of that rally,” she said on Wednesday.

The congresswoman added:

“Democrats have a responsibility for defending our democracy. And in the Senate, we have gavels. There should be subpoenas going out. There should be active investigations that are happening. And I believe that when House Democrats take the majority, we are preparing and ensuring to support the broader effort to stand up our democracy.”

Alito has said his wife flew the American flag upside down after a confrontation with a neighbor.

However, there has been an attempt to link the display to rioters on Jan. 6.

Additionally, there have also been attempts to link the so-called “Pine Tree Flag” or the “Appeal to Heaven” flag to Jan. 6 as some rioters were seen carrying it that day, despite the flag being in existence for over 200 years.
