Former federal prosecutor Andy McCarthy accused a federal judge of trying to “micromanage” immigration enforcement in the Chicago area to boost her chances of being nominated to a higher court on Thursday.

The United States Court of Appeals for the Seventh Circuit stayed an order by U.S. District Judge Sarah Ellis of the Northern District of Illinois, an Obama appointee, requiring Chief Border Patrol Agent Greg Bovino to meet with her daily after attorneys for anti-ICE rioters claimed United States Immigration and Customs Enforcement (ICE) violated her order limiting riot-control tactics. McCarthy told “Fox and Friends” co-host Brian Kilmeade that most federal agents were on “the straight and narrow.”

“I think a lot of these Democratic-appointed district judges, Brian, are kind of auditioning for Supreme Court nominations in the next Democratic administration. So very little of what they do surprises me anymore,” McCarthy said. “But the bottom line is, a district judge is not allowed to micromanage how the police do their job on the street.”

“Our agents are very well trained. In my experience, every now and then you get a rogue agent who does something off the charts,” McCarthy continued, “By and large what I’m talking about, well over 90% of the cases, what ends up happening is cameras and filming these guys and all that sort of thing would do great credit to the job they do on the street. What you have out there is a lot of radical provocateurs who know what they’re doing and are trying to provoke the police into activity that they can spin as abusive.”

Kilmeade asked McCarthy about the indictment of Democratic candidate Kat Abughazaleh on charges of obstructing a federal law enforcement officer during a riot near an ICE facility in Broadview, Illinois. Abughazaleh has been involved in the anti-ICE efforts and was thrown to the ground during a demonstration.

“They go out and protest and there’s a line between dissent and obstruction,” McCarthy said about the protests after discussing what evidence federal prosecutors would use to decide whether to seek charges. “And what they are trying to do is press that line everywhere they can. That’s how the absurd expression ‘mostly peaceful protest’ came to be, right? You have people who are actually out there exercising their First Amendment rights as they are allowed to, but then there are other people who are pushing the envelope and crossing the line into illegal behavior.”

ICE facilities in Chicago and Portland, Oregon, have been the scene of multiple riots as opposition to the agency’s operations targeting illegal immigrants has intensified.

Two people were killed during a shooting at the ICE office in Dallas on Sept. 24, with the gunman taking his own life. There have been two previous incidents in Texas since July 4 where shots were fired at ICE or Border Patrol facilities, with ten people being charged with attempted murder in connection with the ambush on the ICE detention facility.

Resistance to ICE operations to arrest illegal immigrants also included a Milwaukee judge who allegedly helped an illegal immigrant evade ICE agents in April and Democratic Mayor Freddie O’Connell of Nashville releasing the names of ICE agents involved in a crackdown on illegal immigrants in the city in May. In New York City, ICE agents arrested Democratic mayoral candidate Brad Lander on June 18 after he allegedly interfered with an ICE operation in a Manhattan court. Democratic Rep. LaMonica McIver of New Jersey was charged with assaulting an ICE agent after a May incident at an ICE facility in Newark.
