Democratic California Rep. Robert Garcia said Friday that President Donald Trump and first lady Melania Trump would be subpoenaed by his party if they regained control of the House in November.

Former first lady Hillary Clinton testified before the House Oversight Committee Thursday about her knowledge of sex offender Jeffrey Epstein, and former President Bill Clinton gave his deposition about his alleged connections to Epstein Friday. Garcia said on “CNN News Central” that House Democrats would subpoena the Trumps to testify on her alleged connection to Epstein if they win back the House in the 2026 midterm elections.

“By that standard, Congressman, why wouldn’t you also ask First Lady Melania Trump about what she knows or knew about the relationship between Donald Trump and Jeffrey Epstein?” CNN host John Berman asked. 

“Well, I think that’s the question, because right now, the House Republicans have set a new precedent,” Garcia said. “And that new precedent now includes bringing in for depositions presidents, former presidents and first ladies, and then asking those first ladies, as they did yesterday, about how their husbands felt and about what their husbands were doing, which, quite frankly, some of the questioning yesterday was not appropriate. I think the public will see that when when the transcript is fully released. But yes, there’s a precedent now.”

“We now want President Trump to come in and to testify under oath in front of the Oversight Committee. We want the first lady, who we know had a relationship as well with Jeffrey Epstein, to come in under oath and testify to the Oversight Committee,” Garcia continued.

Garcia clarified that anyone who is believed to have had a relationship with Epstein will receive a subpoena on day one, which would include Trump and Melania.

“We’re going to have a very long list of people. Anyone that we believe had a relationship with Jeffrey Epstein on day one will have a subpoena from our committee,” Garcia said. 

Hillary Clinton denied ever meeting Epstein or having any knowledge of his crimes during her deposition. The hearing was abruptly halted when Republican Colorado Rep. Lauren Boebert leaked a photograph of Hillary to conservative podcaster Benny Johnson, though it soon proceeded.

The Clinton’s agreed to testify on Feb. 2 after the former president had been mentioned in the Epstein files that were released by the Department of Justice (DOJ). The DOJ released a photograph in December 2025 that showed Clinton sitting in a hot tub next to Epstein and several girls, which raised questions about his relationship with the sex offender.

A spokesperson for Clinton, Angel Ureña, told The New York Times that Clinton had “nothing to hide” and called for the release of the files.

Clinton was reportedly among among several high-profile figures to send Epstein a birthday letter in 2003 that was later put into an album by Epstein’s former partner, Ghislaine Maxwell, The Wall Street Journal (WSJ) first reported. Trump had also been accused of sending Epstein a birthday letter that year which included a drawing of a naked woman, though Trump vehemently denied ever writing such a letter and sued the WSJ in July 2025 over the allegation.

Trump was one of the first people to call the police on Epstein when the Palm Beach Police Department was investigating him for sexual misconduct in 2006, according to a document related by the DOJ. He also told authorities that Epstein’s then-business partner, Ghislaine Maxwell, was “evil.”

In July 2025, Trump told reporters that he kicked Epstein out of Mar-a-Lago in the early 2000s because he “stole” spa staffers, while other reports suggested that Epstein was removed for making advances toward another member’s teenage daughter. Maxwell told Deputy Attorney General Todd Blanche in August 2025 that Trump was always a perfect gentleman and that she never ever saw him commit any wrongdoing. Epstein’s victims also denied any knowledge of Trump ever committing any wrongdoing.
