Republican Indiana Sen. Jim Banks is introducing a bill Thursday to prevent employees from facing retaliation from their employers for acknowledging the concept of biological sex.
The bill, called the Restoring Biological Truth to the Workplace Act, would clarify that Title VII of the Civil Rights Act of 1964— which prohibits employers from discriminating against workers on the basis of certain characteristics —protects employees who acknowledge or express the binary and biological nature of sex, both inside and outside of the workplace, according to a copy of the bill text first obtained by the Daily Caller News Foundation. The legislation would also clarify that Title VII protects the right of employees to use single-sex bathrooms and changing areas in the workplace.
“This bill is about protecting common sense,” Banks told the DCNF. “Americans shouldn’t fear losing their jobs simply for acknowledging the basic reality of biological sex.”
Banks’ bill comes against the backdrop of President Donald Trump’s day-one executive order, “Defending Women from Gender Ideology Extremism and Restoring Biological Truth to the Federal Government.” The order asserts that federal agencies recognize only “two sexes, male and female,” and also ensures “the freedom to express the binary nature of sex and the right to single-sex spaces in workplaces.” The Trump administration has notably been cracking down on gender ideology in both the federal government and schools across the nation.
Many companies and schools in the U.S. have embraced left-wing views on gender in recent years. The Biden administration notably led a massive push to embed gender ideology and diversity, equity and inclusion (DEI) policies in federal agencies and schools.
In April 2023, the 7th U.S. Circuit Court of Appeals ruled that an Indiana school district had not violated a former music teacher’s rights by encouraging him to resign after he declined to use transgender students’ preferred names and gender pronouns due to religious reasons.
