A United States Customs and Border Protection (CBP) agent testified Tuesday at the trial of a former Department of Justice (DOJ) employee accused of throwing a sandwich at him in August.

CBP Agent Gregory Lairmore told a federal court in Washington, D.C., that after Sean Dunn threw the Subway sandwich at him, his uniform had mustard stains, and an onion string was found near his radio, CBS News reported. Dunn was fired from the DOJ after the incident. He is facing a federal misdemeanor charge after a grand jury in the District of Columbia refused to indict him on felony charges.

Lairmore compared the incident to a “baseball pitch,” saying the sub “exploded all over” him, that the impact was felt through his body armor and that he “could smell the onions and mustard,” according to CBS News. Court documents say Dunn was screaming obscenities and labeling the federal agents “fascists.”

Dunn’s attorney, Julia Gatto, claimed Dunn threw the sandwich as a protest against the federal crackdown on crime in the District of Columbia, according to The Hill.

“It was a harmless gesture at the end of him exercising his right to speak out,” Gatto said. “He is overwhelmingly not guilty.”

Lairmore was cross-examined by lead defense counsel Sabrina Shroff, who claimed that gag gifts given to him by fellow agents, including a “felony footlong” patch and a plush toy shaped like a sandwich, indicated knowledge that the case was overblown, The Los Angeles Times reported. Shroff previously defended two attorneys accused of firebombing a police car during the 2020 George Floyd riots, according to CNN.

The Aug. 10 incident drew responses from both Attorney General Pam Bondi and United States Attorney Jeanine Pirro of the District of Columbia.

“If you touch any law enforcement officer, we will come after you,” Bondi said in an Aug. 14 post on X. “I just learned that this defendant worked at the Department of Justice — NO LONGER. Not only is he FIRED, he has been charged with a felony.”

“This is an example of the Deep State we have been up against for seven months as we work to refocus DOJ,” Bondi added. “You will NOT work in this administration while disrespecting our government and law enforcement.”

President Donald Trump announced the deployment of the National Guard and declared a federal takeover of Washington, D.C.’s Metropolitan Police Department to combat crime in the District of Columbia days after Department of Government Efficiency staffer Edward Coristine, known by the moniker “Big Balls,” was severely injured when he intervened to help a woman being attacked by a mob trying to carry out a carjacking.

“The president’s message to the criminals was, ‘If you spit, we hit,’” Pirro said in the video she posted on X on Aug. 13. “Well, we didn’t quite do that the other night when an individual went up to one of the federal law enforcement officers and started jumping up and down, screaming at him, berating him, yelling at him.”

“And then he took a Subway sandwich … and took it and threw it at the officer. He thought it was funny,” Pirro added. “Well, he doesn’t think it’s funny today because we charged him with a felony, assault on a police officer.”
