The House of Representatives killed a resolution to formally censure Democratic New Jersey Rep. LaMonica McIver on Wednesday afternoon over the congresswoman allegedly assaulting law enforcement at an Immigration and Customs Enforcement (ICE) detention center in May.

Lawmakers initially voted 215 to 207 to table the resolution with Republican Reps. Don Bacon of Nebraska, Mike Turner of Ohio, David Valadao of California, Mike Flood of Nebraska and David Joyce of Ohio joining Democrats to torpedo the censure effort. The resolution would have also booted McIver from her seat on the Homeland Security Committee, which oversees federal immigration authorities, including ICE.

Turner’s office quickly issued a statement clarifying that the congressman’s vote to table the resolution was an accident.

“Congressman Turner supports removing Rep. LaMonica McIver from the Homeland Security Committee. He intended to vote no to table and submitted a correction immediately,” the statement said.

Every Democratic lawmaker who voted opted to kill the resolution sponsored by Republican Louisiana Rep. Clay Higgins to formally punish McIver. Republican Reps. Andrew Garbarino of New York and Nathanial Moran of Texas voted “present.” Garbarino is the chair of the Homeland Security Committee.

Republican Texas Rep. Chip Roy excoriated his Republican colleagues for voting with Democrats to scuttle the censure resolution.

“I was prepared to debate this on the floor alongside @RepClayHiggins after we defeated tabling… yet inexplicably it was not defeated,” Roy wrote on the social media platform X. “She’s on the HOMELAND SECURITY committee & indicted for ‘forcibly impeding law enforcement officers.’ NUTS!”

McIver slammed Higgins for forcing a vote on the resolution in a statement on Tuesday, claiming the confrontation at the ICE detention facility was a part of her congressional duties.

“Clay Higgins moved to force a vote to censure me and remove me from @HomelandDems because I was doing my job,” McIver wrote on the social media platform X.

Acting U.S. Attorney for New Jersey Alina Habba indicted McIver in June on three federal charges over her confrontation at the New Jersey detention center, accusing the congresswoman of “forcibly impeding and interfering with federal officers” as they attempted to arrest an individual.

McIver said she intended to visit the detention center to conduct congressional oversight over the administration’s immigration enforcement efforts. The New Jersey Democrat voted against the Laken Riley Act — legislation requiring the detention of illegal migrants who commit an array of crimes — and the One Big Beautiful Bill Act, which allocated more than $150 billion for immigration enforcement and border security.

“Representative McIver’s continued service on the Committee on Homeland Security, which is charged with oversight of Federal immigration enforcement and other national security matters, would represent a significant conflict of interest,” the resolution states in part.

House Democrats unveiled a retaliatory resolution Wednesday to formally censure Republican Florida Rep. Cory Mills who has generated a string of ethical controversies this year. In August, Miss United States 2024 winner Lindsey Langston accused Mills, her ex-boyfriend, of threatening to release nude videos of her after she ended their relationship — an allegation that Mills has flat-out denied.
