Fox News legal analyst Gregg Jarrett said Monday evening that President Donald Trump will most likely need a whistleblower with “incriminating information” to support his claims that some of former President Joe Biden’s pardons are “void.”

In a post on Truth Social Sunday evening, Trump wrote that he was declaring Biden’s pardons of the “Unselect Committee of Political Thugs” as “VOID, VACANT, AND OF NO FURTHER FORCE OR EFFECT” due to his use of an autopen. On “Hannity,” Fox host Sean Hannity asked Jarrett about Trump’s move, saying that the issue of using an autopen was previously raised under Obama’s administration.

“Yeah, but these are serious questions relative to Joe Biden. Using an autopen is perfectly legal. Many presidents have used it, going back to Harry Truman and probably before,” Jarrett said. “As long as there is consent and authorization. ”

“Now, consent is defined by three things. It has to be voluntary, willing, and conscious,” Jarrett added. “Well, what if you’ve got a president like Joe Biden, who is none of those three things, that is suffering from a declining mental capacity, and he is incapable of granting consent? Then that means those documents, whether they be a pardon or executive order, are null and void.”

Concerns over Biden’s declining mental fitness were raised by Republicans early in his first administration. However, during Biden’s time in the White House, staff and fellow Democrat lawmakers defended his mental fitness, with some, like Democrat Delaware Sen. Chris Coons, saying the president was “on top of his game.”

Following Biden’s disastrous debate against Trump in June 2024, Democrats and corporate media then began to turn on the former president, with many publicly calling for Biden to end his campaign for president.

“Even worse, what if people at the White House operating the autopen weren’t even trying to get his consent, and, simply on their own, behind his back, signing all kinds of documents? That, of course, are the crimes of forgery and fraud. The difficulty here is proof,” Jarrett said.

Jarrett went on to recall how Republican House Speaker Mike Johnson said that Biden didn’t remember signing an executive order, before explaining why obtaining proof would be difficult.

“Getting proof that Biden didn’t authorize or consent is difficult. You can’t really ask him because he doesn’t remember what he had for breakfast. You can’t get people who did it in the White House to confess to forgery and fraud, so you would probably need a whistleblower who has incriminating information, either as a witness or incriminating statements. That is exceedingly difficult to achieve,” Jarrett said.

In January, Johnson told The Free Press’ Bari Weiss that Biden had appeared to have forgotten that he had paused liquefied natural gas (LNG) exports after signing an executive order. When confronted about the LNG pause by Johnson, Biden told the House Speaker, “I didn’t do that.”
