Judicial Watch filed a Freedom of Information Act (FOIA) lawsuit Wednesday alongside Advancing American Freedom (AAF), which was founded by former Vice President Mike Pence, against the U.S. Department of Health and Human Services (HHS) and the Food and Drug Administration (FDA) over records surrounding the abortion pill known as Mifepristone.
The lawsuit was filed after HHS and the FDA failed to respond to FOIA requests filed in May for relevant documents and communications surrounding the approval of the abortion pill, according to a press release. The FDA was previously found to have “failed to address several important concerns” when it relaxed restrictions on the abortion drug, which has a “significant morbidity and mortality” rate, according to the National Institute of Health.
“The FDA has repeatedly refused to acknowledge their role in approving the dangerous abortion drug, mifepristone, and have refused to disclose communications regarding their approval of it,” AAF general counsel Marc Wheat said in the press release.
“Advancing American Freedom has worked tirelessly to disclose the truth behind the FDA’s negligence and to bring justice for the women hurt or killed by this drug,” Wheat continued. “The American people deserve to know the facts of how the FDA shirked protocols in order to expand abortions, even at the cost of the health of the women using the drug. We are grateful to Judicial Watch for picking up AAF’s case.”
In 2021, the FDA lifted the in-person requirement to obtain chemical abortion pills. The following year, pro-life groups and medical professionals sued the FDA for cutting corners to quickly approve mifepristone despite concerns surrounding numerous harmful side effects for the mother and the unborn child.
The lawsuit, which eventually went up to the Supreme Court, was unanimously struck down in June and ruled that the pro-life medical associations doctors did not have standing to challenge the FDA’s decision.
Pro-abortion organizations like Planned Parenthood claim that taking the abortion pill is “very safe” and likened it to over the counter drugs like Tylenol and Viagra. However, there is “significant morbidity and mortality” after taking the abortion pill, of which hemorrhage and infection are the leading causes, according to the NIH.
Most recently, a Georgia woman named Amber Thurman suffered from complications after taking the abortion pill. Thurman and her unborn twins died of sepsis as a result from these complications.
“From the get-go, the abortion pill has been promoted by a corrupted and politicized FDA, contrary to the health of both pregnant mothers and their unborn children,” Judicial Watch President Tom Fitton said in the press release. “The Biden-Harris FDA is covering up key facts about the approval of the abortion pill while simultaneously promoting its wild usage is a scandal.”
