Supreme Court Halts Order Forcing Trump Admin To Pay Out DEI Related Education Grants

The Supreme Court blocked an order on Friday that would force the Trump administration to pay out millions of dollars in teacher training grants.

In a 5-4 decision, the justices halted a lower court’s temporary order that prevented the government from canceling the grants as part of its effort to cut programs related to diversity, equity and inclusion (DEI).

The court wrote states that sued have not “refuted the Government’s representation that it is unlikely to recover the grant funds once they are disbursed.”

U.S. District Judge Myong Joun, a Biden appointee, issued an order March 10 blocking the Department of Education’s (DOE) effort to cancel the grants.

Chief Justice John Roberts would have denied the government’s request, the order notes.

“It is a mistake for the Court to grant this emergency application,” Justice Elena Kagan wrote in a dissent. “Nowhere in its papers does the Government defend the legality of canceling the education grants at issue here.”

Justice Ketanji Brown Jackson, in a dissent joined by Justice Sonia Sotomayor, wrote it is “beyond puzzling that a majority of Justices conceive of the Government’s application as an emergency.” She suggested the government’s argument that the lower court did not have the authority to issue the order is a distraction from the “core questions” involved in the case.

“Children, pets, and magicians might find pleasure in the clever use of such shiny-object tactics,” she wrote. “But a court of law should not be so easily distracted.”
