Former President Joe Biden sued the Justice Department on Tuesday to block the release of audio recordings and transcripts of an interview obtained by the special counsel who investigated his handling of classified materials.

The audio recordings and transcripts are from an interview with ghostwriter Mark Zwonitzer in 2017 for Biden’s memoir, “Promise Me, Dad: A Year of Hope, Hardship, and Purpose,” according to ABC News. The files were investigated by former special counsel Robert Hur after looking into Biden’s improper retention of classified documents, according to the New York Post.

The investigation led to a nearly 400-page report that was released on Feb. 8, 2025, the outlet reported.

President Donald Trump reacted to a report of the lawsuit Tuesday simply writing in a Truth Social post, “A Crooked Politician!!!”

“These materials included (1) marked classified documents about military and foreign policy in Afghanistan, and (2) notebooks containing Mr. Biden’s handwritten entries about issues of national security and foreign policy implicating sensitive intelligence sources and methods,” the report said, according to the New York Post.

Biden’s lawyers argued that the disclosure of the recordings and transcripts would “constitute an unwarranted invasion of President Biden’s privacy,” the outlet reported.

“Every American, including a sitting or former Vice President, has a right to privacy in the personal conversations he has within his own home,” his attorneys wrote, according to the Post.

Biden’s lawsuit is seeking that the materials not be shared with the Heritage Foundation or Republicans, ABC News reported.

The lawsuit has claimed the DOJ will release the audio recordings and transcripts on June 15 to the Heritage Foundation and the House Judiciary Committee unless a court order blocks the release, according to the outlet.
