U.S. Attorney General Pam Bondi is promising swift legal action after a federal judge dismissed criminal indictments against former FBI Director James Comey and New York Attorney General Letitia James.
According to Fox News, Bondi used her appearance in Memphis on Monday — where she was showcasing the work of the city’s “Safe Task Force” — to sharply condemn the ruling and stress that the cases are nowhere near finished.
Her remarks came after U.S. District Judge Cameron Currie tossed both sets of charges, finding that the prosecutor who brought them — Lindsey Halligan — had not been lawfully appointed as interim U.S. Attorney for the Eastern District of Virginia.
The judge agreed with Comey’s defense team, which argued that the invalid appointment made the indictments defective.
Bondi told reporters the Justice Department intends to fight the ruling immediately.
“We’ll be taking all available legal action, including an immediate appeal, to hold Letitia James and James Comey accountable for their unlawful conduct,” she said.
She also defended the seriousness of the allegations.
“I’m not worried about someone who has been charged with a very serious crime,” Bondi said. “His alleged actions were a betrayal of public trust.”
Comey was indicted in September 2025 for allegedly making false statements to Congress and obstructing a congressional inquiry related to his 2018 testimony about Crossfire Hurricane, the FBI investigation into possible ties between the 2016 Trump campaign and Russia.
Comey has denied all wrongdoing, insisting his testimony was “truthful to the best of my recollection,” and characterizing the case as “a political hit job, not a pursuit of justice.”
Letitia James was indicted separately in October 2025 on mortgage and bank-fraud charges. Prosecutors accused her of falsely claiming a Virginia home was a secondary residence in 2020 to obtain more favorable loan terms. They allege she benefited by nearly $19,000 over the life of the loan.
Defense teams for both James and Comey argued the prosecutions were deeply flawed, citing procedural irregularities and Halligan’s disputed appointment.
Halligan, a former Trump legal aide, was the sole federal prosecutor to sign Comey’s indictment while acting as U.S. Attorney for the Eastern District of Virginia.
Bondi defended Halligan’s role and credentials in her Memphis remarks.
“We have made Lindsay Halligan a special U.S. attorney so she is in court, she can fight in court just like she was, and we believe we will be successful on appeal,” Bondi said.
She went further, praising Halligan’s work and criticizing those who opposed her appointment.
“And I’ll tell you, Lindsay Halligan — I talked to all of our U.S. attorneys, the majority of them around the country — and Lindsay Halligan is an excellent U.S. attorney. And shame on them for not wanting her in office. Thank you,” she said.
