The Department of War issued a public update Tuesday on its ongoing review of Sen. Mark Kelly, D-Ariz., after a viral video sparked accusations that the former Navy captain encouraged treasonous behavior among service members.
According to Fox News, in a post on X, the department said its leadership is examining “potentially unlawful conduct” connected to Kelly’s appearance in the video, titled “Don’t Give Up the Ship.”
The clip circulated widely earlier this month and drew sharp criticism from opponents who argued Kelly’s message crossed legal and ethical lines for a retired officer.
War Secretary Pete Hegseth formally ordered the review and set a deadline for results.
“The Department of War recently received information regarding potentially unlawful comments made by CAPT (Ret) Mark E. Kelly in a public video, on or about November 18, 2025,” Hegseth wrote in a letter accompanying the update.
“I am referring this, and any other related matters, for your review, consideration, and disposition as you deem appropriate,” he continued.
Hegseth directed the letter to Navy Secretary John Phelan, noting Kelly’s prior service as a Navy captain before entering politics.
“Please provide me a brief on the outcome of your review by no later than December 10, 2025,” the letter concluded.
Kelly, now serving in the U.S. Senate, has not commented publicly on the latest action from the department. The video at the center of the controversy remains online and continues to fuel debate about the boundaries for retired military leaders who move into public office.
