Hunter Biden’s prosecutor has slammed President Joe Biden over his claim that his son was unfairly targeted, calling the president’s criticism of the case baseless.

According to The Wall Street Journal, in a new report sent to Attorney General Merrick Garland from special counsel David Weiss, which was released Monday, Weiss sternly rebuked President Biden’s comments, and denounced them as baseless accusations and fundamentally wrong.

“The President’s characterizations are incorrect based on the facts in this case, and, on a more fundamental level, they are wrong,” Weiss wrote.

Hunter Biden was convicted on several charges in 2024, including tax evasion and gun charges.

However, despite repeatedly saying he was not going to pardon his son, President Biden formally pardoned his son’s criminal convictions in December prior to his sentencing that was earmarked to take place in Los Angeles and Delaware — of which Hunter Biden had plead guilty to a raft of felony charges and was potentially facing a lengthy prison sentence for his convictions.

According to the pardon, President Biden wrote that Hunter Biden was “selectively, and unfairly prosecuted” in an effort to “break Hunter,” with the president noting his “serious addiction” issues had played a part in his late tax filings and the reason why he failed to correctly fill out a form when he purchased a firearm.

The pardon covered Hunter Biden’s actions all the way back to 2014, which covered his time on the board of Ukranian gas company, Burisma.

“No reasonable person who looks at the facts of Hunter’s cases can reach any other conclusion than Hunter was singled out only because he is my son — and that is wrong,” Biden wrote, “There has been an effort to break Hunter — who has been five and a half years sober, even in the face of unrelenting attacks and selective prosecution.”

Biden went on to call the case a “miscarriage of justice,” and that he hopes the American people will understand.

“I also believe raw politics has infected this process and it led to a miscarriage of justice — and once I made this decision this weekend, there was no sense in delaying it further. I hope Americans will understand why a father and a President would come to this decision,” Biden said.

Meanwhile, Weiss, upon submitting his report to the Justice Department, attested the case against Hunter Biden was not a ruse to get at the president, and decried President Biden’s claims that the prosecution had undermined the justice system.

“Other presidents have pardoned family members, but in doing so, none have taken the occasion as an opportunity to malign the public servants at the Department of Justice based solely on false accusations,” Weiss wrote, adding, “Politicians who attack the decisions of career prosecutors as politically motivated when they disagree with the outcome of a case undermine the public’s confidence in our criminal justice system.”

The WSJ notes Weiss had been special counsel on the Hunter Biden case since 2023 and had been investigating allegations into Hunter Biden during his time as Delaware’s U.S. Attorney, of which he was appointed to by President Donald Trump.
