This case was an action to recover personal property. The jury specially found that the plaintiff and defendant were partners regarding the property at issue. The court held that the plaintiff had no right to recover because the property was rightfully in the defendant's possession as a partner, and the complaint contained no allegation of partnership or request for dissolution and an accounting. The judgment for the defendant was therefore affirmed.
