The case concerned two defendants who were each issued citations for both speeding and driving under a suspended license (DUS) from the same traffic stops; after pleading guilty to speeding in district court, they were separately prosecuted and convicted for DUS. The Pennsylvania Supreme Court granted review to determine whether Section 110 of the Crimes Code barred the later DUS prosecutions. The Court held that the Commonwealth was prohibited from prosecuting the DUS charges because they arose from the same criminal episode, were known to the prosecutor before the speeding pleas, and fell within the jurisdiction of a single court. It further ruled that the defendants had not waived their Section 110 claims by pleading guilty to speeding without objecting, as the burden to consolidate rests on the Commonwealth and mere silence does not constitute waiver. The Court therefore reversed the Superior Court and vacated the DUS convictions.
