Fox News legal analyst Gregg Jarrett lit into the Supreme Court Monday, saying they allowed a federal judge to become a “super-president” and costing the country $2 billion.

The Supreme Court declined Wednesday to vacate an injunction by United States District Judge Amir Ali of the District of Columbia in a 5-4 ruling in which Chief Justice John Roberts and Associate Justice Amy Coney Barrett joined with the high court’s three liberal associate justices, to require the Trump administration to pay $2 billion for foreign aid to various organizations. Jarrett said that the damage done by allowing Ali’s ruling to stand extended beyond the financial implications of the ruling.

“It’s important for our audience to know how the legal system really dropped the ball here in my view with a district court judge really setting foreign policy,” Fox and Friends co-host Brian Kilmeade told Jarrett.

“Yeah, making himself a super president and you know, the Supreme Court justice Sam Alito accused this district court judge, his name is Amir Ali of abusing his authority, ignoring the law on sovereign immunity, which is clear,” Jarrett responded. “And Alito’s right, the president has vested powers under the Constitution to order executive agencies to freeze money, do it for reasons of foreign policy, national security, to avoid waste.”

Actions of the Department of Government Efficiency (DOGE) to reign in wasteful spending at government agencies, including the United States Agency for International Development (USAID) and the Social Security Administration (SSA) have been challenged in courts with mixed results. A federal judge recently blocked a memo sent to federal agencies instructing them to dismiss thousands of probationary workers, while other courts have allowed DOGE to carry out its activities.

“So, you know, this decision by Judge Ali, who by the way, is a Biden appointee who’s been on the court for a nanosecond that forces Trump to spend $2 billion is judicial activism run amok,” Jarrett said. “I think it will eventually be overturned by the Supreme Court, but by then it’s too late. This judge is forcing Trump to pay $2 billion. They’ll never get that back.”
