Sen. Rand Paul (R-Ky.) is suggesting that the Supreme Court should use lie detector tests to uncover the source of the leak of a draft opinion in a major abortion cases.

During an appearance on “Fox & Friends” Thursday, Paul said, “Frankly there are times when I think [an employer] could ask for a lie detector test.”

“This is a very important [opinion], and if the Supreme Court holds it, I’d bring in the 12 people and I’d ask them all under oath and with a lie detector test, ‘Did you leak this document?’ Because this shouldn’t happen,” he continued.

Paul added, “And liberal or conservative, we don’t want violence, but we also don’t want somebody working at the Supreme Court who’s a liar and who’s dishonest.”

Paul’s comments refer to the leaked draft of an opinion, obtained by Politico, that appears to show that the Supreme Court is poised to overturn Roe v. Wade.

Sen. Ted Cruz (R-Texas) speculated that “some angry, left-wing law clerk” was behind the leak of the draft.

“The reason it was leaked is some left-wing presumably law clerk wanted to put political pressure on the five justices that presumably are in the majority right now,” he said on Fox News earlier this month.

He added, “They wanted to put heat and they wanted to invoke politics to try to get them to change their vote. And by the way, if that left-wing law clerk succeeds, it will be the most grotesque politicization of the Supreme Court in the history of our nation.”

During a recent segment of the “Verdict with Ted Cruz” podcast, the Texas senator said, “I think it is very, very likely a law clerk. And it is very, very likely a law clerk for one of the three liberal justices.”

“That means there are 12 human beings who are your likely suspect pool. That’s not a big likely suspect pool. It is likely to be someone who is a hard partisan, and who was willing to burn the place down because he or she was so upset about what happened,” he continued.

Cruz went on to say that he believes the clerk works for Justice Sonia Sotomayor.

When co-host Michael Knowles asked why he believes it is a Sotomayor clerk, Cruz said, “Because she’s the most partisan of the justices. And so she’s the most likely to hire wild-eyed partisans as clerks.”

“I have no evidence of that, I’m just making an inference,” he stipulated.
