Anteriormente, ele serviu como prefeito da cidade de Varsóvia de 2002 a 2005. Antes desses mandatos, Kaczyński serviu como Presidente do Supremo Órgão de Auditoria de 1992 a 1995 e posteriormente como Ministro da Justiça e Procurador-Geral da República no gabinete de Jerzy Buzek de 2000 até sua demissão em julho de 2001.
