En derecho de contratos, un error es una creencia equivocada, al momento de contratar, de que ciertos hechos son verdaderos. Puede alegarse como defensa y, si se plantea con éxito, puede llevar a que el acuerdo en cuestión se considere nulo ab initio o anulable, o bien, los tribunales pueden otorgar un remedio equitativo. El common law ha identificado tres tipos diferentes de error en los contratos: el 'unilateral mistake', el 'mutual mistake' y el 'common mistake'. La distinción entre el 'common mistake' y el 'mutual mistake' es importante.
