El Código Penal portugués fue adoptado en 1982 por el Decreto-Ley n.º 400/82, de 23 de septiembre, entrando en vigor el 1 de enero de 1983. Ha tenido múltiples enmiendas, pero ha sido objeto de dos reformas importantes en 1995, por el Decreto-Ley n.º 48/95, de 15 de marzo, y en 2007, por la Ley n.º 59/2007. El Código Penal dedica un capítulo a los “crímenes contra la vida humana”, donde se incluye el asesinato; a pesar de que otros crímenes, en su forma agravada, pueden considerarse, en otros países, como incluidos en el asesinato.
