Familia y educación
Era el hijo menor de Sir William Cusack-Smith, 2nd Baronet, Baron of the Exchequer y su esposa Hester Berry, hija del mayor Thomas Berry (Irish Volunteers) de Eglish Castle, único firmante de la Birr Declaration en 1782. Era nieto de Sir Michael Smith, 1st Baronet, Master of the Rolls in Ireland de 1801 a 1806 y su primera esposa Maryanne Cusack. Se educó en Trinity College Dublin. Ingresó en Lincoln's Inn en 1817 y fue llamado a la Irish Bar en 1819. Se casó con Louisa Smith-Barry, hija de James Hugh Smith-Barry, de la conocida familia Smith-Barry que poseía Fota Island, Cork. Tuvieron un hijo, William y cinco hijas, Hester, Marianne, Anne, Caroline y Frances.
