A Canadian man vacationing in Las Vegas has had his stay extended by court order after he allegedly stole and tortured a flamingo.

Las Vegas Justice Court Judge Harmony Letizia told Mitchell Fairbarn of Ontario, Canada, Monday he must stat in the area as his criminal proceedings play out, per NewsNation.

Fairbarn, 33, faces four counts of felony animal abuse for allegedly injuring a bird at the Flamingo Las Vegas Hotel & Casino March 3.

An attorney appeared in court on Fairbarn’s behalf Monday morning, but Letizia told the attorney she expected Fairbarn to be in her courtroom.

Surveillance footage reviewed by police showed Fairbarn entering the bird habitat and grabbing a bird named “Peachy,” documents read. 

Fairbarn also allegedly injured other animals in the process. This included “pinning down” another bird and “not letting it escape.” 

The video also shows Fairbarn going back to a hotel room with the animal, police said.

Fairbarn allegedly admitted to police he went into the bird habitat after seeing a flamingo in distress. He told police he “popped” the bird’s wing into place.

Police found “several photos and videos” on his phone of Fairbarn with the animal, including him torturing it, police said.

Fairbarn said he was taking the bird home to Canada.

The Las Vegas Justice Court covered Fairbarn’s face in the photos and stills from the videos when it fulfilled a public records request.

Animal control said Fairbarn injured the bird when he allegedly “pulled the wing out of the bird’s body,” police said. Several other birds were also injured.

During a probable cause hearing, Las Vegas Justice Court Judge Suzan Baucum set bail at $12,000 and ordered Fairbarn to have no animals in his possession. He also had to surrender his passport and wear a GPS monitor.

Letizia warned Fairbarn’s attorney Monday she would remand him to jail if he violated any terms of his release.

“If he has a single violation while he’s out on bail and electronic monitoring that was set by the judge in initial appearance court, he is going to be remanded without bail in this case,” she said.

Fairbarn was scheduled to return to court on May 6.
