Erika Kirk, widow of Turning Point USA founder Charlie Kirk, is invoking her rights to a speedy trial amid what she says are delay tactics from her husband’s accused killer, Tyler Robinson.
According to Fox News, in a court filing made public over the weekend, her attorney, Jeffrey Neiman, formally notified the Utah court that Kirk is seeking a swift resolution under state law.
“The Utah Code affords victims of a crime ‘the right to a speedy disposition of the charges free from unwarranted delay caused by or at the behest of the defendant,’” Neiman wrote.
The filing emphasizes that while the court must ensure Robinson receives a fair trial, it also has a duty to protect the victim’s right to avoid prolonged delays. “This Court must balance Mrs. Kirk’s right to a speedy trial,” Neiman added.
Robinson is accused of shooting Charlie Kirk during a Turning Point USA event at Utah Valley University in September. Kirk was speaking under a campus tent when a sniper’s bullet struck him in the neck, prompting chaos among the audience.
Prosecutors have reportedly completed around 90% of discovery, but Robinson has yet to enter a plea or face a preliminary hearing, which would determine if there is probable cause to move forward with the case.
Chicago-based defense attorney Donna Rotunno, a Fox News contributor, called Kirk’s filing “a very good strategic move to put the judge on notice that everyone is watching,” even if it may not strictly apply under the law.
“Nobody believed in the importance of the United States Constitution more than Charlie Kirk,” Neiman wrote, noting that while defendants are guaranteed rights to a fair and speedy trial, those rights do not extend to causing undue delay.
Robinson is scheduled to return to court on February 3 for the second day of a hearing over his defense team’s motion to remove the local prosecutor from the case, a request many legal analysts have dismissed as “frivolous.” Prosecutors have denied any conflict of interest tied to a deputy whose adult child was in the crowd during the shooting.
As the case moves forward, Erika Kirk is making clear she intends to see justice delivered without further unnecessary delay.
