The judge overseeing the Sean “Diddy” Combs’ sex trafficking and racketeering case dismissed a juror Monday morning.
Prosecutors pointed out last week that there were discrepancies in the juror’s residency, per Fox News.
“There is nothing the juror can say at this point that can put the genie back in the bottle and repair his credibility…” Judge Arun Subramanian said Monday before testimony continued.
A question concerning diversity was brought up by the defense who wanted to keep the juror because of his ethnicity or, if he was dismissed, a mistrial should be granted.
“The court cannot and should not let race factor into what it should do,” Subramanian said, adding there was no evidence of prosecutorial misconduct.
The juror said during voir dire he lived in the Bronx with his fiancé and daughter.
Subramanian said there were several inconsistencies in the juror’s statements. He said either the juror was unable to follow simple instructions and answer the questions or he was deceitful.
Another juror’s spot on the panel was brought into question Monday as the juror was asked to stay in court the entire day for further questioning.
