SiriusXM’s Megyn Kelly said Tuesday on her show that “dumb” Democratic New Jersey Gov. Phil Murphy, who claimed to be housing an illegal migrant in his home, could potentially face federal charges for his actions.
During an event on Saturday, Murphy dared U.S. Immigration and Customs Enforcement (ICE) agents to come to his home, saying he was allowing an illegal migrant to live above his garage. On “The Megyn Kelly Show,” Kelly said that border czar Tom Homan was now aware of the incident, adding that Murphy “ensured” the migrant’s deportation.
“He’s so dumb. He already flagged it. He already flagged it for Tom Holman. It’s too late. Tom Holman’s going to see what’s in that upstairs apartment. I have no doubt of it. Honestly, if he finds an illegal in there, apparently she’ll flee. I imagine she’d flee by the time Holman gets there. He’s going to find out,” Kelly said.
“Who was it? You can’t avoid this. He’s going to find out who it was,” Kelly added. “The governor probably just ensured that woman’s deportation. Guess what else, Mike? The governor could potentially face felony charges.”

Kelly went on to read 8 U.S. Code Section 1324, which states that “bringing in and harboring certain aliens” is “a felony punishable by up to five years in prison.” The SiriusXM host quoted how “any person who knowingly or in reckless disregard of the fact that an alien has come to, entered or remains in the United States in violation of law conceals, harbors or shields from detection or attempts to conceal, harbor or shield from detection” could be applied to Murphy’s admission, potentially having him punished by prison.
“I would advise the governor to hire a lawyer because, again, Tom Holman’s not messing around. I imagine there will be ICE agents knocking on the door of that garage to see if there are illegal immigrants,” said guest Mike Davis, who clerked for U.S. Supreme Court Justice Neil Gorsuch.
Following Murphy’s remarks, Homan vowed on Fox News Monday to “look into” the matter, saying that either he or Department of Homeland Security Secretary Kristi Noem “will seek prosecution.” However, a close source to Murphy reportedly told Fox News that no one had legitimately moved into the governor’s home, adding he was “just talking about someone in his broader orbit who was on edge over the broader climate and was concerned.”
Since President Donald Trump’s first week in office, ICE agents have conducted raids throughout various cities across the United States, as the president reversed former President Joe Biden’s policies and allowed agents to arrest “criminal aliens,” including rapists and murderers.
