A Delaware federal judge upheld a November 2023 verdict that Guardant Health willfully infringed TwinStrand Biosciences and the University of Washington patents for Duplex Sequencing, ordering Guardant to pay more than $245.2 million, including damages, supplemental damages, accrued royalties, and interest, and to continue paying a 6% royalty on 11 products that represented about 90% of revenue through March 2033 with quarterly accounting. The ruling confirms patent validity and imposes ongoing royalty obligations through the patent expiry, with Guardant facing further financial exposure as interest continues to accrue.
