Appeals Court Finds ICE Violated Detention Due Process
The 10th U.S. Circuit Court of Appeals ruled 2–1 that ICE violated its regulations and due-process protections by failing to promptly give Kaveh Abedi an informal interview after revoking his supervised release and rearresting him in Kansas in 2025. The court rejected the Trump administration’s argument that the six-month limit on immigration detention could restart after each release and rearrest, warning that repeated detention periods separated by brief freedom would undermine detainees’ rights. Abedi, who received asylum as a child after fleeing Iran and has complied with supervised-release conditions for more than two decades, had previously been protected from deportation to Iran under the Convention Against Torture. The appeals court found the Kansas district court had applied the legal standards incorrectly.
