County authorizes potential Project Jupiter breach notice
Doña Ana County commissioners voted unanimously to authorize formal notice to Project Jupiter developers of a potential breach of the industrial revenue bond agreements, over Oracle’s proposed arrangement with El Paso Electric. The agreements call for the data center to generate power through an onsite microgrid without connecting to the utility, while Oracle has proposed using El Paso Electric for emergency backup power and support during construction. The vote authorizes county officials and legal counsel to raise the issue and seek a path forward; it does not determine that the developers violated the agreements or revoke the project’s bond authorization.
