Court Vacates Dealer Murder Charge in Toddler Overdose
California’s Sixth District Court of Appeal unanimously ordered prosecutors to drop the implied-malice murder charge against Phillip Michael Ortega in the 2023 fentanyl overdose death of toddler Winter Rayo. The court said that although Ortega supplied fentanyl to Rayo’s parents and showed conscious disregard for human life, his actions were too remote from the parents’ conduct to support a murder prosecution; he had not placed the drugs within the child’s reach or directly made them accessible. Rayo’s parents were convicted of second-degree murder and child endangerment, while Ortega still faces child-endangerment and drug-related charges. The published ruling could affect a separate murder case against Ortega tied to another infant’s fentanyl death, and prosecutors say they are considering a challenge.
