Investor sues Emmitt Smith, alleges $2.5M wind farm loan misused

The lawsuit claims the money was instead used to repay an earlier investor, while Smith and Mosley misrepresented efforts to secure Department of Energy financing for Project Exodus, planned between Austin and San Antonio. Kituwah says the project failed to progress, the defendants stopped responding to inquiries, and the loan has accrued about $600,000 in interest. The company is seeking a jury trial to determine damages, and the allegations have not been proven in court.
