Class action alleges FuelCell misled investors on manufacturing capacity
Several law firms announced that investors who bought FuelCell Energy securities from June 24 through September 1, 2026, are covered by a filed securities class action, with November 10 as the deadline to seek lead-plaintiff status. The complaints allege that FuelCell misrepresented or failed to disclose whether its manufacturing capacity could meet delivery requirements under an agreement with Fit Energy for up to 380 megawatts of fuel-cell systems, while production delays and costs were undermining the contract’s profitability. FuelCell’s September 2 earnings report disclosed a $17 million charge associated with the agreement, a $45.3 million quarterly net loss, and production below the level needed to align costs with contract pricing. These are allegations in the lawsuit, not findings of liability.
