Jury backs New Hampshire eminent domain for I-93 exit
A New Hampshire jury unanimously ruled that the state’s use of eminent domain to acquire land for the I-93 Exit 4A project is for a legitimate public purpose, reasonably necessary, and expected to provide a net public benefit. The case was brought by companies owned by developer Steven Trefethen, who argued the interchange and related Folsom Road improvements primarily benefit the Woodmont Commons development in Londonderry while harming his properties and the town of Derry. The state said the project will address longstanding traffic congestion, improve roadway safety, and support economic vitality, with any benefit to the private development incidental. The verdict followed a four-day trial, and the project could be completed by 2032.
