Clancy Hearing Weighs Dismissal, Possible Retrial
Prosecutors said they intend to retry Lindsay Clancy over the 2023 deaths of her three children, though they have not decided which charges to pursue. Her September murder trial ended in a mistrial after an 11–1 jury split, with most jurors reportedly favoring a finding that she was not criminally responsible because of mental illness. Clancy’s defense is seeking dismissal on double-jeopardy grounds, arguing the judge should have investigated the lone holdout juror’s reported difficulty applying the reasonable-doubt instructions; prosecutors say the jury was genuinely deadlocked and the mistrial was proper. Clancy acknowledges killing her children, while her lawyers say postpartum psychosis impaired her responsibility and prosecutors contend she acted deliberately and understood her actions. The court also considered access to juror records and limits on public statements, and scheduled a Nov. 16 hearing to address the case’s status and possible timetable.
