Formerly President Donald Trump will be allowed to attend his son Barron’s high school graduation.

Judge Juan Merchan made the announcement Tuesday in court. Merchan is presiding over the hush money criminal case against Trump, per Fox News.

“I don’t think the May 17 date is a problem,” Merchan said of Barron Trump’s graduation date.

Trump asked the court earlier to attend Barron Trump’s graduation. Since then Trump has been vocal about the judge possibly declining his request.

“(Barron’s) a great student and he’s very proud of the fact he did so well and was looking forward for years to having his graduation with his mother and father there, and it looks like the judge isn’t going to allow me to escape this scam. It’s a scam trial,” Trump said earlier this month.

It is not known at this time if the trial will be put on hold that day or if Trump will be absent from court.

Barron Trump attends a private high school in south Florida.

Trump is currently on trial in Manhattan. He is where he is facing 34 felony counts of falsifying business records.

Also on Tuesday, Merchan found Trump in contempt of court for violating a gag order which prohibits him from speaking publicly about witnesses and family members of court officials. The judge said he violated the order nine times  and fined him $1,000 for each violation.

Before court started, Trump said the case was a hoax and that Merchan should recuse himself.

“This is a hoax. This is a judge who is conflicted. Badly, badly, badly conflicted. I’ve never seen a judge so conflicted and giving us virtually no rulings,” Trump said.

“I’m going to sit in the freezing cold icebox for eight hours, nine hours or so. They took me off the campaign trail. But the good news is my poll numbers are the highest it’s ever been. So at least we’re getting the word out. And everybody knows this trial is a scam. It’s a scam. The judge should be recused, that he should recuse himself today he should recuse himself today. And maybe he will,” Trump said.
