CBS News Hit With $20 Million Lawsuit Over Teen’s Arrest Footage

A Maryland teenager is seeking $20 million from CBS News, alleging the network falsely portrayed him as one of five people arrested for vandalizing the Lincoln Memorial Reflecting Pool.
According to Fox News, the 15-year-old, identified in the lawsuit as “JV,” filed the defamation case Wednesday in U.S. District Court in Washington, D.C.
His attorneys argue CBS used footage of his detention while reporting on the vandalism, creating the impression that he was involved in the alleged federal crime.
According to the lawsuit, JV was never arrested or accused of damaging the Reflecting Pool. Instead, he was briefly detained after riding an e-bike in the area and was released without charges.
The complaint centers on a CBS report anchored by Jericka Duncan. During the broadcast, Duncan told viewers that five people had been arrested in connection with the vandalism while footage showed JV in handcuffs.
The lawsuit claims the network’s online and social-media versions went further by showing JV’s face as the report discussed the arrests. His attorneys contend the combination of the footage and narration made it appear that the teenager was among those accused of damaging the pool.
The complaint also alleges that JV was visually confused with David Hearn, an adult who was later indicted on a felony charge connected to the vandalism.
JV’s attorneys argue CBS had access to the original footage and should have known that the teenager’s detention was unrelated to the Reflecting Pool incident. They accuse the network of either knowing the portrayal was false or acting with reckless disregard for whether it was accurate.
The lawsuit says the report had significant reach, with the social-media video receiving at least 1.8 million views. JV’s legal team claims the teenager suffered embarrassment, humiliation, anxiety, sleep loss and emotional distress, while also worrying that the report could affect his education, athletic opportunities, employment and future career.
The complaint says CBS later issued an on-air correction but argues that the correction came too late to reverse the damage caused by the original report.
CBS News declined to comment on the pending lawsuit.
The case comes after a separate legal development involving the Reflecting Pool vandalism. A judge permanently dismissed the case against former Olympian David Hearn, who had been accused of damaging the $14 million renovation project in June.
