Pro-2A Groups Call On Supreme Court To Hear Out-Of-State Carry Permit Case

Pro-Second Amendment organizations asked the Supreme Court to strike down Minnesota’s refusal to recognize out-of-state permits Tuesday.

Ten states, including Minnesota, do not recognize any concealed carry permits issued by other states as of Tuesday, according to GunVera.com. The Second Amendment Foundation (SAF), National Rifle Association (NRA), California Rifle and Pistol Association (CRPA), Second Amendment Law Center, Minnesota Gun Owners Caucus and the Citizens Committee for the Right to Keep and Bear Arms (CCRKBA) asked the justices to hear a case brought by a long-haul trucker whose concealed carry permits issued by Georgia and Florida are not recognized by Minnesota, saying the trucker’s constitutional rights were being violated.

“Earlier this year, this Court explained how a hypothetical young woman would struggle trying to exercise her right to carry in Hawaii,” the groups said in the brief. “Imagine if that same young woman also frequently travels and wants to carry a firearm to defend herself in each state she visited. The monetary cost of acquiring a permit in every state that requires one, to say nothing of the time investment, would be astronomical.”

“Interstate visitors are Americans, yet states like Minnesota treat them like suspect foreigners that need to be re-vetted before exercising a fundamental right,” the brief continues.

Liberty Justice Center first filed the lawsuit in January 2025 against Minnesota Department of Public Safety Commissioner Bob Jacobson over the state’s refusal to recognize the out-of-state concealed-carry permits of two truck drivers, David A. McCoy II and Jeffrey A. Johnson Sr. In the petition asking the Supreme Court to hear the case filed Aug. 24, the group accused Minnesota of turning the Second Amendment into a “second-class right.”

Gun Owners of America (GOA) and the group’s Oregon state director, Cynthia Ladd, sued the city of Salem, Oregon, and Marion County, Oregon, Sheriff Nick Hunter Friday in the United States District Court for the District of Oregon, demanding that the state’s ban on non-residents carrying firearms be ruled a violation of the Second Amendment.
