Federal prosecutors unsealed a new criminal case against former FBI Director James Comey on Monday in Washington, D.C. The charges accuse him of illegally sharing national defense information with a reporter during the 2016 election.
President Donald Trump responded immediately to the news with sharp words for the former official. He told reporters, “I think he’s a dirty cop, James Comey. But I know nothing about it.” He added that he had just heard about the filing.
The New Espionage Charges
According to the Daily Wire, the new indictment includes two counts under the Espionage Act. Prosecutors allege Comey directed someone to leak secret information to a national news publication. The alleged act happened on October 5, 2016, while he led the FBI under President Barack Obama.
Per amNewYork, this marks the third time the Justice Department has tried to charge him with a federal crime. The first attempt in 2025 involved lying to Congress, but that charge was thrown out after misconduct. A second attempt earlier this year involved a picture of seashells that prosecutors claimed spelled a message against Trump.
Patrick Fitzgerald, Comey’s attorney, stated that two separate U.S. attorneys previously looked at this same leak and chose not to file charges. According to Fitzgerald’s statement to the press, the Department of Justice has tried to indict Mr. Comey for a federal offense for the third occasion within a span exceeding one year.
Conflicting Views on the Case
Comey released a video statement Monday accusing the government of abusing its power. He remarked that the situation would be nearly humorous were it not an egregious misuse of the Department of Justice that we must not grow desensitized toward. He also noted that he still maintains his innocence.
Former federal Judge John Jones called the new charge unprecedented in his review of the case. Jones stated to amNewYork that throughout the annals of the Department of Justice and the history of United States jurisprudence, nothing comparable to this has ever occurred. According to the charge, Comey allegedly caused defense information to be sent to someone unauthorized to receive it, having been communicated, delivered, and transmitted.
The case now moves forward in federal court while legal teams prepare their next steps. Fitzgerald confirmed that “Mr. Comey steadfastly maintains his innocence” as the government proceeds with this third effort. The Justice Department files remain open as the court sets its schedule.
