Comey Faces Two New Federal Charges
Former FBI Director James Comey faces two federal charges of unlawfully transmitting national defense information and conspiring to transmit it. Prosecutors filed a criminal information under seal on Oct. 5, 2026, in the U.S. District Court for the District of Columbia; a judge unsealed it Monday at Comey's request. The filing alleges he directed an intermediary to disclose information to a reporter in October 2016 but does not name the reporter, publication or information. Comey was not indicted by a grand jury. His attorneys argue that omission makes the prosecution legally invalid. In a Substack video Monday he said, "Well, they're back, again," and "Nothing has changed with me. I'm still innocent," and that he is "still not afraid of these people and I still believe in the independent judiciary." This is the third federal case against him in the Trump administration. An earlier case was dismissed. A separate North Carolina case over a seashell post reading "86 47," which the Justice Department calls a threat to President Trump, remains pending.
